PREAMBLE
- Whereas , fully recognizing that several years of weak and bad leadership has weakened the social structure and the rule of law in Nigeria, conscious of the urgent need to raise the nation to the highest level of responsible and selfless leadership with moral and intellectual dignity, determined to evolve the means of reconciling and uniting Nigeria by giving chance to all part of the country to participate in governance at one time of the other through rotational presidency and other elective positions and by imbibing the true spirit of oneness and brotherhood,
- We, the citizens of like-minds in Nigeria, from North to South, East to West, mindful of the necessity to remedy the social economic and political decay that exist in the country, have, with a sense of duty, decided to bring and foster unity of all citizens of Nigeria and have therefore resolved as follows:
- To actualize and conform with the principles of power shift and power rotation system of government.
- To raise the consciousness of the citizens of Nigeria by the creation of a laudable socio – political conditions conducive to national peace and unity guaranteed to all component of the Country through an equitable distribution of resources and opportunities.
- To mobilize citizens of Nigeria under the leadership of AFRICAN REFORMATION PARTY [ARP] to create a nation that is built on power rotation capable of satisfying the hopes and aspirations of Nigerians.
NOW THEREFORE, WE THE MEMBERS OF AFRICAN REFORMATION PARTY [ARP] as progressive patriots determined to rebuild Nigeria and guarantee equal opportunities for all, mutual and peaceful co-existence with a deep sense of patriotism and nationalism HEREBY MAKE, ENACT AND DECLARE the following CONSTITUTION for the effective administration of our PARTY and promotion of its aims and objectives.
CHAPTER ONE – GENERAL PROVISIONS
ARTICLE 1 NAME OF THE PARTY
There shall be a Party to be named, known and called AFRICAN REFORMATION PARTY hereinafter in this Constitution referred to as THE PARTY with the abbreviation/acronym ARP.
ARTICLE 2 SUPREMACY OF THE CONSTITUTION
Subject to the provisions of the Constitution of the Federal Republic of Nigeria 1999 [as amended] and any other law in force in the Country, the provisions of this Constitution shall be SUPREME and have a binding force on all members and organs of the PARTY.
ARTICLE 3 THE MOTTO
The Motto of this PARTY shall be KNOWLEDGE IS POWER.
ARTICLE 4 THE SLOGAN
The Slogan of the PARTY shall be ONE NIGERIA, ONE NATION! ONE NATION, NON-NEGOTIABLE
ARTICLE 5 THE FLAG AND LOGO
The Logo of the PARTY shall be the map of Nigeria embedded in green background which reflect one nation and unity with immense natural resources. Inside the map are hand, pen, book and light. The hand indicate strength and dedication to duties, our willingness and commitment to harness and use the nation’s resources productively while the pen, book and light indicate a quest for knowledge and power to transform Nigeria to greatness.
ARTICLE 6 REGISTERED OFFICE
The Registered Office of the Party shall be situated within the Federal Capital Territory, Abuja and there shall be other regional, states and local government offices as the Party may from time to time approve.
ARTICLE 7 CHARACTER AND ETHICS
(1) The PARTY shall be a democratic organization/body that shall pursue its aims and objectives without regard to race, gender, creed, political Party or ethnic affiliations.
(2) The policies and programs of the PARTY shall be determined by its leadership who shall be accountable to the members.
(3) The PARTY shall be a Pan-Nigeria and shall strive to recruit members across all regions and states of the federation and diaspora.
(4) The PARTY shall respect the linguistic, cultural and religious diversity of its members, in pursuit of its objectives.
(5) The PARTY shall support the emancipation and active participation of youth and women in politics and political offices at all levels.
(6) The PARTY shall draw support from all sections of the country at the time of contesting for elections in Nigeria.
(7) The PARTY shall respect the freedom of expression and free exchange of ideas and information without undermining the authority and integrity of the PARTY.
(8) The Party shall promote Federal Character as enshrined in the Constitution of the Federal Republic of Nigeria
ARTICLE 8 AIMS AND OBJECTIVES
- To promote and foster unity among all regions and ethnic groups in the country, political stability and national consciousness of Nigerians through rotational presidency and other elective positions.
- To adhere to the policy of power rotation and zoning of elective political positions in pursuance of the principles of equity, justice and fairness.
- To sustain mutual peaceful co-existence in rebuilding Nigeria, in order to guarantee equal opportunity for all and to implement deep sense of patriotism and nationalism.
- To sponsor and support all members aspiring for political positions in all elections in Nigeria.
- To promote self-respect, self-reliance and human dignity in Nigerian politics.
- To advance the social, political, educational and economic interest of members and act as a means of communication with the government.
- To ensure the political empowerment of Nigerians especially the youths, women and the physically challenged by encouraging their active participation in political activities.
- To uphold the integrity and sovereignty of the Federal Republic of Nigeria as one united, indivisible and indissoluble political entity.
- To evolve, develop and promote the spread of the PARTY throughout the Country as well as mobilizing support of citizens abode in other countries.
- To co-operate with any other political Partyor other Organizations whose aims and objectives are in harmony with those of the PARTY.
- To uphold the independence of the Judiciary and the Fundamental Human Rights of every citizen as enshrined in the Constitution of the Federal Republic of Nigeria 1999 [as amended].
- To promote cross integration of culture and socialaffiliation among regions irrespective of cultural and religious difference.
- To ensure and uphold religious tolerance as ameans to achieving peaceful co-existence inareligiously plural society like Nigeria.
- To undertake other activities that in the opinion of the PARTY may promote the attainment of the Party’s objectives.
CHAPTER TWO
MEMBERSHIP
ARTICLE 9 ADMISSION INTO MEMBERSHIP
- Membership of this PARTY shall be open to any citizen of the Federal Republic of Nigeria who has attained the age of eighteen [18] and who accepts the character, ethics, aims and objectives of the PARTY, provided that such person is not a member of other political Party(ies) or organization[s] whose policies and programs are inconsistent with those of the PARTY.
- Membership shall be initiated from the Ward, Local Government, Senatorial division or State in Nigeria where the person is born, resides, works or originates.
- Admission into membership of the PARTY shall be registered electronically on the PARTY’s website and approved by the Ward, Local Government, State or National Executive Committee of the Party as the case may be.
- The Party reserve the right to decline the registration of any person for good reasons provided that the applicant shall have the right to make an appeal to the State or National Executive Committee for review of the application.
- A duly registered member shall be issued an Identification Card which shall bear the membership number and photograph of the member.
- Any member who fails to carry out the website registration and obtain a Membership Identification number (generic code) shall not be eligible to any rights and privileges due to members.
ARTICLE 10 RULES AND REGULATIONS
(1) Every member of the PARTY shall be obliged to observe the rules and regulations as embedded in this Constitution.
(2) Members shall affirm the aims and objectives of the PARTY and conduct themselves in a manner that shall not bring the PARTY to public odium and disrepute.
(3)Only registered financial members shall have the right to participate in the activities of the PARTYsuch as elections, campaigns, rallies and other functions as may be specified.
ARTICLE 11 RIGHTS AND PRIVILEGES
(1) Subject to the provisions of this Constitution and other rules and regulations, all members shall have the following rights and privileges:
a] Fully registered financial members of the PARTY shall have the right to vote and be voted for into any elective position subject to the provisions applicable to such elective position as contained in this Constitution.
b] Subject to sub-article (1) above, members shall enjoy the privileges of the PARTY and shall be entitled to be appointed or elected to any Committee of the PARTY upon the approval of the Executive Council at the various levels.
c] All members contesting for any elective position must be sponsored from their respective Wards.
d] Members shall enjoy the privilege of representing the PARTY at national and international conferences or events subject to the approval of the National Executive Council.
e] Members shall enjoy the privileges of being recommended to any person, body or institutions etc for any purpose that is consistent with the aims and objectives of the PARTY.
ARTICLE 12 TERMINATION OF MEMBERSHIP
(1) The membership of any person shall be terminated if any of the following happens:
a. If he or she dies.
b. If he or she withdraw and or resigns as a member.
c. If he or she is found guilty and expelled from the PARTY on any ground of misconduct as provided in this Constitution.
d. If he or she is convicted of any crime involving fraudulent activities and / or any other offences considered by the State Executive Council as being incompatible with membership of the PARTY.
e. If he / she joins any Organization whose aims and objectives are not compatible with that of the PARTY.
f. Upon termination of membership by any of a-c above, the member shall be obliged to return to the PARTY all its properties.
ARTICLE 13 MEMBERSHIP RESIGNATION/WITHDRAWAL PROCESS:
- Any member who wishes to withdraw his membership shall notify the appropriate level Secretary in writing.
- Membership withdrawal application shall be considered within 30 days by the Ward Executive Committee, after which the member may be free to leave. For any Party official or any Party member holding any office at Federal, State or Local Government level, such membership withdrawal shall only be considered by the Executive Committee at the appropriate level.
- Any member holding an elective or appointive office who wishes to withdraw his membership from the Party, shall while notifying the Party of his withdrawal also tender a letter of resignation of that office.
ARTICLE 14 RE-JOINING THE PARTY:
- Any person or persons willing to re-join the Party after leaving the Party shall apply for membership through his Ward. The application shall be considered within 30 days for acceptance or refusal by the Ward Executive Committee provided that where no answer is received within the time stipulated above, it is deemed to have been accepted.
- A member who rejoin the Party or re-absolved into the Party after his initial membership was terminated may be placed on 6 months’ probation and may lose the previous status or position held in the Party before decamping or his exit from the Party by other means except where waiver is granted by the Executive Committee at the appropriate level.
- the Party may however from time to time, issue additional guidelines on procedures for re-joining the Party and or reconsideration of any person whose membership was terminated in accordance with the provision of this constitution or any bye law made pursuant thereto.
CHAPTER THREE
ARTICLE 15: CODE OF CONDUCT
The PARTY hereby considers the following as the conduct that shall guide every member, all its activities and operational system in the pursuit of its aims and objectives.
- Every member shall belong to and take active part in the activities of the PARTY from his or her Ward.
- Every member must take necessary steps to understand, propagate and execute the aims and objectives of the PARTY.
- Every member must guide against any propaganda detrimental to the PARTY.
- Every member must defend the policies and programs of the PARTY.
- No member shall align with other Party, Organization or groups to undermine the PARTY or its elected Officers.
- Everymember must observe discipline, behave honestly, and carry out the decisions of the leadership of the PARTY loyally.
- Amember must not, at any level, divulge the proceedings and decisions of the PARTY, except expressly authorized.
- No member shall publish or distribute to the public, any article which purports to be the view of another organization or group.
- Every member shall ensure that he or she is duly registered as a voter in the constituency of his or her state of origin or residency.
- Every member shall be eligible to vote and be voted for at the Party’s meetings, elections etc, subject to the provisions of this Constitution.
- No member of the Partymust engage in violent conduct or acts capable of inciting pandemonium at any of its gatherings.
- No member must bring the disagreement or conflict of interest within the Partyto the public, except expressly authorized.
- Every member shall oppose religious, cultural or political intolerance or any other form of discrimination.
- All Officers elected or appointed at all levels, on the platform of the Partyshall be guided by the provisions of this Constitution and decisions of the leadership of the Party.
ARTICLE 16 OBLIGATIONS OF THE PARTY TO MEMBERS
- The PARTY shall create opportunities for its members to serve and shall adopt measures that encourage volunteer services.
- The PARTY shall create and maintain deliberate measures aimed at strengthening the aspirations of its members through laudable services.
- The PARTY shall encourage regular gatherings and social activities aimed at developing familiar bonds among its members.
- The PARTY shall uphold the sanctity of life, human dignity and security of its members at any official outing or activity.
- The PARTY shall educate and keep members abreast of latest developments on issues and activities that are of paramount interest to it.
CHAPTER FOUR
GUIDELINES AND RULES FOR SOCIAL MEDIA OPERATIONS
PART ONE – GENERAL PROVISIONS
ARTICLE 17
- Members must always keep to the purpose for which the Partyis formed. All posts and comments must be on the subject matter of discussion.
- There must be no arguments, heated opinions and no hyped up drama on any issue whatsoever.
- Members must not use the group platform to berate or air personal grievances. Such issues must be addressed through private chats.
- There shall be no insults or attacks on members. Foul and abusive languages, immoral and defamatory comments are prohibited.
- No politics of bitterness is allowed on any platform. There must be no attack against any individual or government via inflammatory posts.
- No pornographic, illicit or hideous matters should be posted on the Party’s social media or group platforms.
- Unauthorized formation of social media group is prohibited.
- Violations of this rules shall attract strict disciplinary sanctions and such group shall be shut down immediately.
- Members are free to exit any group without creating an offence.
PART TWO – SPECIFIC PROVISIONS
ARTICLE 18 RIGHT OF CREATION OF SOCIAL MEDIA GROUP PLATFORMS.
The below listed Executive Officers shall create the following platforms on behalf of the PARTY and such platforms shall remain the exclusive property of the PARTY :
(1) NATIONAL CHAIRMAN
The National Chairman shall have the sole right to form the following platforms:
a] All National Platforms
b] All regional and State platforms
c] Twitter and Instagram platforms
d] National Facebook platforms
e] National Telegram platforms
(2) DEPUTY NATIONAL CHAIRMAN
The Deputy National Chairman shall form the following platforms:
a] All State Executive platforms
b] All LGA/LCDA general platforms
c] All Regional Executive platforms
d] All State Telegram platforms
(3)REGIONAL CHAIRMEN
The Regional Chairmen/Chairpersons shall form the following platforms:
a] Regional Official Executive platform within his/her region.
b] Regional Facebook, Twitter, Instagrametc
(4) REGIONAL EXECUTIVE OFFICERS
The Regional Executive Officers shall form the following platforms:
a] All LGA/LCDA Executive platforms within their region.
b] All LGA/LCDA Chairmen platforms

CHAPTER 5
PART ONE -STRUCTURE OF THE PARTY
ARTICLE 21 ORGANIZATION AND ADMINISTRATION
(1) The PARTY shall be organized and administered at the following levels:
- Ward
- Local Government Area [LGA]/Local Council Development Area (LCDA)
- Senatorial Division/District
- State
- Regional
- National
(2) Each of these levels shall have a functional Secretariat except for senatorial district where they might be considered unnecessary by the appropriate executive committee.
(3) For the purpose of the Organization and activities of the PARTY, the following shall be recognized as states under the PARTY:
a] All the 36 states of Nigeria
b] 37th State – The Federal Capital Territory [FCT]
ARTICLE 22 THE ORGANS OF THE PARTY
(1) The PARTY shall have the following principal organs:
a. National Convention
b. The Board of Trustees
c. The National Executive Committee
d. The National Working Committee
e. Regional Executive Committee
f. Regional Working Committee
f. State Congress
g. State Executive Committee
h. State Working Committee
i. Senatorial Division Congress
j. Senatorial Division Executive Committee
k. Senatorial Division Working Committee
l. Local Government Area/Area Council Congress
m. Local Government Area/Council Executive Committee
l. Local Government Area/Council Working Committee
m. Ward congress
n. Ward Executive Committee
o. Ward working Committee
(2) The PARTY shall have the following other bodies (caucus) whose members must have been honored with an Award:
a. Caucus Leaders Committee
b. National Caucus
c. Regional Caucus
d. State Caucus
e. Local Government Area/ Council Caucus
(3) The PARTY shall have seven[7] highest decision making body/advisory bodies as follows:
- Caucus Leaders Committee
- Board of Trustees
- National Executive Committee [NEC]
- National Working Committee [NWC]
- Executive DisciplinaryCommittee
- Governing Advisory Council
- Appointment Implementation Committee
(4) The PARTY shall also have the following Standing Committees/directorates for its activities:
a. External Relations Committee
b. Research and Media Publicity Committee
c. Constitution Review Committee
d. Training and Manpower Development Committee
e. Logistics Committee
f. Directorate of Treasury and Revenue
ARTICLE 23 ELIGIBLITY TO CAUCUS MEMBERSHIP
(1) The following shall be the conditions for eligibility into the membership of all the caucus listed in this constitution:
a. Must be non-executive members
b. Must be an Awardee of an honour from the PARTY
c. Must be sponsored from the ward level
d. Must be recommended by the Directorate of Treasury and Revenue
(2) The number of members of each caucus shall be a minimum of fifteen [15] and a maximum of fifty [50].
Article 24 DUTIES OF CAUCUS MEMBERS
(1) The Caucus shall be the highest decision making body of the PARTY and their decisions on any internal political affairs shall be final.
(2) The Caucus shall function as the last resort for any decision making of the PARTY without recourse to any legal battle or litigation in any court of law.
(3) All legal actions in any court of law shall without prejudice be reverted to the Caucus for final decision on any matter relating to the party’s internal affairs or party members.
(4) They shall perform the duties of Stakeholders to the PARTYnotwithstanding that they do not hold any executive position other than being caucus members.
PART TWO – COMPOSITION OF ORGANS OF THE PARTY
ARTICLE 25 BOARD OF TRUSTEES
There shall be a Board of Trustees of the PARTY which shall consist of:
a. The National Convener who shall be the chairman of the Board of Trustees
b. The National Chairman
c. The Deputy National Chairman
d. The immediate past National Chairman
e. The immediate past Deputy National Chairman
f. The National Secretary
g. The members of the National Executive Committee.
h. Fifteen founding members of the PARTY.
i. One woman who must be an Awardee/Honorary member from each geo-political region of the Country, nominated by the Regional Executive Committee to the National Working Committee for approval by the National Executive Committee.
j. One representative of the youth who must be an Awardee/Honorary member from each geo-political region of the Country, nominated by the Regional Executive Committee to the National Working Committee for approval by the National Executive Committee.
k. Persons not exceeding one hundred [100] who have contributed immensely to the growth of the PARTY and found suitable to be members of the Board.
l. The membership as stated in paragraph k above shall reflect the thirty seven [37] Constituent states of the PARTY as follows:
m. Two [2] members each from the thirty seven states
n. Any other twenty two [22] persons nominated by the National Executive Committee.
o. Four (4) members to be recommended by the National Convener
p. All members of the Caucus Leaders Committee are automatic members of the Board of Trustee.
ARTICLE 26 ELECTION AND TENURE OF MEMBERS OF THE BOARD OF TRUSTEES
The Board of Trustees shall:
(1) Elect the National Convener as the Chairman and any other person from its members found capable to be a Secretary, both of whom shall be members of the National Executive Committee.
(2) Without prejudice to the provisions of this Constitution, ensure that person to be elected as Secretary is of proven integrity and has contributed immensely to the growth of the PARTY.
(3) Ensure that the Chairman and the Secretary shall serve a term of four (4) years single term except for the founding leader who may be re-elected for another term.
ARTICLE 27 QUALIFICATION FOR MEMBERSHIP OF THE BOARD OF TRUSTEES
(1) Aperson shall be qualified for membership into the Board of Trustee if he or she:
- Is a registered card carrying member of the PARTY.
- Has contributed immensely to the growth and advancement of the PARTY.
- Has attained the minimum age of twenty-five [25] years.
- Is a person of proven integrity?
- Has not been adjudged to be a lunatic or otherwise declared to be of unsound mind under any Law in force in any part of Nigeria
- Has not been convicted by any Court of competent jurisdiction for an offence relating to fraud or dishonesty.
(2) Without prejudice to the provisions of this Constitution, all members of the Board of Trustees shall serve a term of four [4] years only without a reelection except the founding members who shall be eligible to seek a re-election.
ARTICLE 28 FUNCTIONS OF THE BOARD OF TRUSTEES
The Board of Trustee shall, subject to the provisions of this Constitution:
- Ensure the highest standard of morality in all activities of the PARTY by acting as a conscience of the PARTY with the power to call to order any Officer of the PARTY whose conduct falls below standard.
- Ensure that the PARTY and its members enjoy high moral standard and good image before the Nigerian populace especially at the National level.
- Harmonize, coordinate, review and advise on policies and programs of the PARTY at the National level.
- Coordinate the sourcing of funds for the PARTY.
- Be vested with the assets of the PARTY and serve as Custodians of such assets.
ARTICLE 29 REMOVAL AND RESIGNATION OF BOARD MEMBERS
(1) A member of the Board of Trustees shall be removed and or cease to hold office:
a. By the National Caucus and/or the resolution of the National Convention on the recommendations of the National Executive Committee, on the ground of infirmity or misconduct.
b. If he/she resigns his/her membership by tendering a letter to that effect to the National Convention.
c. If he/she is removed from the office by virtue of which he or she became automatic member of the Board of Trustees under this Constitution.
(2) Fresh selection shall be made to fill any vacancy in the Board where applicable.
ARTICLE 30 MEETINGS OF THE BOARD OF TRUSTEES
(1) The Board of Trustees shall meet at the instance of the National Convener or at the request of half of its members or following the resolution of the National Executive Committee, such meeting having been preceded by the mandatory virtual meeting via social media.
(2) The quorum for the meeting of the Board shall be two third (2/3) of its members drawn from at least two-third [2/3] of the Constituent states of the PARTY and a simple majority shall pass any motion.
PART THREE
NATIONAL EXECUTIVE COMMITTEE
ARTICLE 31 COMPOSITION OF THE NATIONAL EXECUTIVE COMMITTEE
There shall be a National Executive Committee of the PARTY which shall consist of:
- The National Chairmanas the Chairman.
- The two Deputy National Chairman, one for the North and the other for the south.
- Six National Vice Chairmen, one from each geo-political zone of the Country (to be also known as regional Chairmen)
- The National Secretary
- The Deputy National Secretary
- The Chairman and Secretary of the Board of Trustees.
- The National Treasurer and Deputy National Treasurer.
- The National Financial Secretary and Deputy National Financial Secretary
- The National Organizing Secretary and Deputy National Organizing Secretary.
- The National Publicity Secretary and the Deputy National Publicity Secretary.
- The National Legal Adviser and the Deputy National Legal Adviser, both of whom must be Legal Practitioners.
- The National Woman Leader and Deputy National Woman Leader.
- The National Youth Leader and Deputy National Youth Leader.
- The National Auditor and Deputy National Auditor.
- All Regional Chairmen and other Executive Officers.
- All State Chairmen and other National Executives.
- Six Ex-Officio members, at least two of whom shall be women, elected from each of the six geo-political zones.
- All past National Chairmen, Deputy National Chairmen, National Secretaries, Regional Chairmen, Chairmen and Secretaries of Board of Trustees who are Awardees/Honorary members of the PARTY.
ARTICLE 32 FUNCTIONS OF THE NATIONAL EXECUTIVE COMMITTEE
1. The National Executive Committee shall:
a. Supervise and direct the work of the PARTY and all its organs from the National to the Ward in all the Constituent States.
b. Ensure that all the organs function democratically and effectively.
c. Carry out the decisions and instructions of the National Convention.
d. Initiate policies and programs for approvalby the National Convention.
e. Prepare reports and budgets for approval by the National Convention.
f. Make rules for the discipline of the PARTY which shall be binding onall members
g. Consider appeals and other matters referred to it by the Regions and States of the Federation.
h. Make standing orders for approval by the National Convention.
i. Manage and control all assets and properties of the PARTY wherever they may be.
j. Treat any other matters referred to it by the National Convention or the Board of Trustees.
k. Confer such honors as may aid the realization of the objectives of the PARTY.
2. The decisions of the National Executive Committee shall be binding on all the Organs and members of the Party.
ARTICLE 33 MEETINGS OF THE NATIONAL EXECUTIVE COMMITTEE
- The National Executive Committee shall meet at least once in every quarter at the request of the National Chairman or a motion of any other members supported by atleasttwo-third of the committee membership in the Committee’s group social media meeting.
- An emergency meeting may be summoned by the National Chairman having regard to the circumstances of the agenda.
- All meetings shall be presided over by the National Chairman or in his absence by any of the two Deputy National Chairmen and in the absence of both, any of the six Regional Vice National Chairmen may be elected by the meeting to preside.
- The quorum of the National Executive Committee meeting shall be two-third Majority of its members drawn from at least two-third of theConstituent states of the PARTY and a simple majority shall pass any motion provided that member who are unable to attend physically but join through virtual/video conference means shall be counted as being present at the meeting.
PART FOUR
NATIONAL WORKING COMMITTEE
ARTICLE 34 COMPOSITION OF THE NATIONAL WORKING COMMITTEE
There shall be a National Working Committee which shall consist of:
- The National Chairman who shall be the Chairman.
- The two Deputy National Chairman, one for the North and the other for the south.
- Six National Vice Chairmen, one from each geo-political zone of the Country (to be also known as regional Chairmen)
- The National Secretary
- The Deputy National Secretary
- The National Treasurer
- The National Financial Secretary
- The National Organizing Secretary
- The National Publicity Secretary
- The National Legal Adviser, who shall be a Legal practitioner.
- The National Woman Leader
- The National Youth Leader
- The National Auditor
- All Regional Deputyand Vice Chairmen.
ARTICLE 35 FUNCTIONS OF THE NATIONAL WORKING COMMITTEE
The National Working Committee shall:
- Be responsible for the day to day administration of the PARTY and shall be responsible to theNational Executive Committee.
- In case of an emergency, act on behalf of the National Executive Committee.
- Perform such other functions as may be assigned to it by the National Executive Committee.
ARTICLE 36 MEETINGS OF THE NATIONAL WORKING COMMITTEE
- The National Working Committee shall meet not less than once every fortnight at the instance of the National Chairman or by two-third majority of members.
- The meeting shall be preceded by a virtual meeting where the request and agenda of the meeting shall be set and adopted.
- The quorum of the National Working Committee meeting shall be two-thirdMajority of its members drawn from at least two-third of the geo-political regions of the Country, and a simple majority shall pass any motion.
PART FIVE
REGIONAL EXECUTIVE COMMITTEE
ARTICLE 37 COMPOSITION OF THE REGIONAL EXECUTIVE COMMITTEE
There shall be a Regional Executive Committee which shall consist of:
- ViceNational Chairmanfrom the region who shall be the Chairman of the Committee
- Regional Secretary
- All members of the National Executive Committee from the region
- All State Chairmen from the region
- All members holding elective position as Chairman, Vice Chairman, senators or House of representative members from the region.
- Any other person or offices as the national executive committee may from time to time designate to be member of the Regional Executive Committee
ARTICLE 38 FUNCTIONS OF THE REGIONAL EXECUTIVE COMMITTEE
The functions of the Regional Executive Committee shall be:
- Harmonize, coordinate and review all activities of the PARTY in the region.
- Establish ad-hoc or standing committees of the PARTY in the region.
- Prepare agenda for and summon meetings atthe regional level.
- Implement National Executive Committees’ decisions in the region.
- Ratify and supervise the Disciplinary andConstitutional Review Committee from time to time.
- Carry out any other function assigned to itby the National Executive Committee.
ARTICLE 39 MEETINGS OF THE REGIONAL EXECUTIVE COMMITTEE
- The Regional Executive Committee shall meet not less than once in every quarter at the instance of the National Convener and/or the National Chairman, provided that two-third of the members of the Committee shall have power to summon an extra ordinary meeting.
- All meetings shall be preceded by an online meeting where the agenda of the proposed meeting shall be set and agreed upon.
- The quorum of the Regional Executive Committee meeting shall be one-third of its membership drawn from at least two-third of the States in the region and a simple majority shall pass any motion.
PART SIX
REGIONAL WORKING COMMITTEE
ARTICLE 40 COMPOSITION OF THE REGIONAL WORKING COMMITTEE
There shall be Regional Working Committee which shall consist of:
- Regional Chairman who shall be the Vice National Chairman from the Region
- Regional Secretary who shall be the Secretary
- Regional Treasurer
- Regional Financial Secretary
- Regional Organizing Secretary
- Regional Legal Adviser who shall be a Legal Practitioner
- Regional Publicity Secretary
- Regional Woman Leader
- Regional Youth Leader
- Regional Auditor
ARTICLE 41 FUNCTIONS OF THE REGIONAL WORKING COMMITTEE
The Regional Working Committee shall:
- Undertake the general administration of the PARTY at the regional level and shall be responsible to the Regional Executive Committee.
- Liaise with the National Executive Committee and the State Chapters of the PARTY.
- Prepare and submit reports for the consideration of the Regional Executive Committee.
- Perform such other functions as may be assigned to it by the National Executive Committee.
ARTICLE 42 MEETINGS OF THE REGIONAL WORKING COMMITTEE
- The Regional Working Committee shall meet not less than once every forth night, and its quorum shall be two-third of its membership drawn from at least two of the states in the region and a simple majority shall pass any motion.
- All Regional Working Committee meeting shall be preceded by online meeting where the agenda of the proposed meeting shall be set and agreed upon.
PART SEVEN
STATE EXECUTIVE COMMITTEE
ARTICLE 43 COMPOSITION OF THE STATE EXECUTIVE COMMITTEE
There shall be a State Executive Committee which shall consist of:
- State Chairman
- Deputy State Chairman
- Senatorial District Chairmen [one from each of the senatorial division/district in the state]
- Senatorial District DeputyChairman from the state
- All other Senatorial District Executive members
- State Secretary
- Assistant State Secretary
- State Treasurer
- Assistant State Treasurer
- State Financial Secretary
- Assistant State Financial Secretary
- State Organizing Secretary
- Assistant State Organizing Secretary
- State Legal Adviser and Assistant State Legal Adviser both of whom shall be Legal Practitioners
- State Publicity Secretary
- Assistant State Publicity Secretary
- State Auditor
- Assistant State Auditor
- All Local Government Area Party Chairmen and Deputy Party Chairmen
- All Local Government Council Chairmen and Vice Chairmen who are members of the PARTY.
- All National Executive Committee members from the State
- All Regional Executive Committeemembers from the State
- All members of the Board of Trustees from the State
- All other Executive positions as may be allotted by the National Executive Committee
ARTICLE 44 FUNCTIONS OF THE STATE EXECUTIVE COMMITTEE
The functions of the State Executive Committee shall be:
- To undertake the general administration of the PARTY in the State.
- To implement the decisions and policies of the State Congress, National Executive Committee, National Working Committee and the Board of Trustees.
- To ratify the decisions of the State Working Committee.
- To identify and resolve the political, social, economic issues and any other issues that are of concern to the State.
- To prepare the annual budget of the State branch of the PARTY.
ARTICLE 45 MEETING OF THE STATE EXECUTIVE COMMITTEE
(1) The State Executive Committee shall meet at the instance of the State Chairman, not less than once every quarter provided that such meeting shall be preceded by an online meeting where the agenda for the proposed meeting shall be set and agreed upon.
(2) An extra ordinary meeting of the State Executive Committee shall be held, if requested for, through an online meeting, by two-third majority of the members of the Committee.
(3) The quorum of the State Executive Committee meeting shall be one-third of the members of the Committee drawn from the senatorial divisions/districts of the State.
PART EIGHT
STATE WORKING COMMITTEE
ARTICLE 46 COMPOSITION OF THE STATE WORKING COMMITTEE
There shall be a State Working Committee which shall consist of:
- State Chairman who shall be the Chairman
- Deputy State Chairman
- Senatorial division/district Chairmen, one from each senatorial division/district of the State.
- State Secretary
- State Treasurer
- State Financial Secretary
- State Legal Adviser, who shall be a Legal Practitioner.
- State Organizing Secretary
- State Publicity Secretary
- State Woman Leader
- State Youth Leader
- State Auditor
ARTICLE 47 FUNCTIONS OF THE STATE WORKING COMMITTEE
The State Working Committee shall:
- Undertake the day-to-day administration of the PARTY in the State and shall be responsible to the State Executive Committee.
- Perform such other functions as may be assigned to it by the State Executive Committee.
ARTICLE 48 MEETINGS OF THE STATE WORKING COMMITTEE
- The State Working Committee shall meet not less than twice a month at the instance of the Chairman. Such meeting shall be preceded by an online meeting, where the agenda of the proposed meeting shall be set and agreed upon.
- An extra-ordinary meeting of the State Working Committee shall be held if requested by two-third of the members of the Committee and such meeting shall be held within seven [7[ days of the request.
PART NINE
SENATORIAL DISTRICT EXECUTIVE COMMITTEE
ARTICLE 49 COMPOSITION OF THE SENATORIAL DISTRICT EXECUTIVE COMMITTEE
There shall be a Senatorial District Executive Committee in each of the three Senatorial Districts of a State, which shall consist of:
- Senatorial District Chairman
- Deputy Senatorial District Chairman
- Members of the National, Regional, State Executive Committees from the Senatorial District.
- Senatorial District Secretary
- Senatorial District Legal Adviser who shall be a Legal Practitioner.
- Senatorial District Publicity Secretary
- Senatorial District Organizing Secretary
- Senatorial District Women Leader
- Senatorial District Youth Leader
- The Physically Challenged Leader
- All elected Local Government Area/Council Chairmen, Secretaries and Treasurers from the Senatorial District who are members of the PARTY
- Three Ex-Officio members elected by the Senatorial District Executive Committee, one of whom shall be a woman.
- The Governor and Deputy Governor of the State elected on the platform of the PARTY who are from the Senatorial District.
- All members of the National and State Executive Committees of the PARTY from the Senatorial District.
- All serving and past members of the National and State Assembly from the Senatorial District who are members of the PARTY.
- All members of the Board of Trustees from the Senatorial District.
- All members of the Caucus Leaders Committee from the Senatorial District.
ARTICLE 50 FUNCTIONS OF THE SENATORIAL DISTRICT EXECUTIVE COMMITTEE
The Senatorial District Executive Committee shall:
- Undertake the general administration of the PARTY in the Senatorial District and implement the decisions of the Senatorial District Committee.
- Coordinate the policies, programs and operations of the PARTY in the Senatorial District .
- Identify and resolve social, political and economicissues of concern to the PARTY in the Senatorial District.
- Liaise with the Local Government Area within the Senatorial District and State headquarters.
- Prepare the annual budget of the PARTY in the Senatorial District.
- Receive the Senatorial District report.
ARTICLE 51 MEETINGS OF THE SENATORIAL DISTRICT EXECUTIVE COMMITTEE
- The Senatorial District Executive Committee shall meet monthly and report to the State Working Committee prior to the State Executive Committee meetings. Such meeting shall be preceded by an online meeting where the agenda of the proposed meeting shall be set and agreed upon.
- The quorum of the Senatorial District Executive Committee meeting shall be one-third of the membership of the Committee drawn from at least two-third of the Local Government Areas in the Senatorial District and a simple majority shall pass a motion.
PART TEN
SENATORIALDISTRICT WORKING COMMITTEE
ARTICLE 52 COMPOSITION OF THE SENATORIAL DISTRICT WORKING COMMITTEE
There shall be SenatorialDistrict Working Committee which shall consist of:
- SenatorialDistrict Chairman
- Deputy SenatorialDistrict Chairman
- SenatorialDistrict Secretary
- SenatorialDistrict Treasurer
- SenatorialDistrict Financial Secretary
- SenatorialDistrict Organizing Secretary
- SenatorialDistrict Legal Adviser who shall be a Legal Practitioner

ARTICLE 53 FUNCTIONS OF THE SENATORIALDISTRICT WORKING COMMITTEE
The Senatorial District Working Committee shall:
- Undertake the general administration of the PARTY at the SenatorialDistrict level and shall be responsible to the SenatorialDistrict Executive Committee.
- Liaise with the National Executive Committee and the State Chapters of the PARTY.
- Prepare and submit reports for the consideration of the SenatorialDistrict Executive Committee.
- Perform such other functions as may be assigned to it by the National Executive Committee.
ARTICLE 54 MEETINGS OF THE SENATORIALDISTRICT WORKING COMMITTEE
- The SenatorialDistrict Working Committee shall meet not less than once every forth night, and its quorum shall be two-third of its membership drawn from at least two of the states in the region and a simple majority shall pass any motion.
- All SenatorialDistrict Working Committee meeting shall be preceded by online meeting where the agenda of the proposed meeting shall be set and agreed upon.
PART ELEVEN
LOCAL GOVERNMENT AREA EXECUTIVE COMMITTEE
ARTICLE 55 COMPOSITION OF THE LOCAL GOVERNMENT AREA EXECUTIVE COMMITTEE
There shall be a Local Government Area and AreaCouncil Executive Committee of the PARTY which shall consist of:
- Chairman
- Deputy Chairman
- All Ward Chairmen in the Local Government Area/ Area Council

ARTICLE 56 FUNCTIONS OF THE LOCAL GOVERNMENT AREA EXECUTIVE COMMITTEE
The functions of the Local Government Area/ Area Council shall be to:
- Undertake general administration of the PARTY in the Local Government Area/ Area Council
- Receive and implement reports from the Ward on
i] Membership
ii] Fund raising
iii] Strategies for political campaigns and electoral success
iv] Mobilization of Voters.
- Provide strategies for effective communication between the Wards and the Local Government Area/ Area Council.
- To implement the decisions of and policies of other higher organs of the PARTY.
ARTICLE 57 MEETINGS OF THE LOCAL GOVERNMENT AREA EXECUTIVE COMMITTEE
- The Local Government Area/ Area Council Executive Committee shall meet at least twice in a month.
- The meeting shall be summoned by the Local Government Area/ Area Council Chairman.
- An extra-ordinary meeting shall be held,if requested for by two-third of the members of the Committee and such meeting shall be at least seven [7] days after the request.
- The request for the meeting shall be preceded by an online meeting where the agenda of the proposed meeting shall be set and agreed upon.
- The quorum of the meeting shall be one-thirdof its membership drawn from at least two-third of the Wards in the Local Government Area/ Area Council, and a simple majority shall pass a motion.
PART TWELVE
LOCAL GOVERNMENT WORKING COMMITTEE
ARTICLE 58 COMPOSITION OF THE LOCAL GOVERNMENT WORKING COMMITTEE
There shall be a Local Government Working Committee which shall consist of:
- Local Government party Chairman who shall also be the Chairman of the Committee
- Deputy Local Government party Chairman
- Ward Chairmen.
- Local Government Secretary
- Local Government Treasurer
- Local Government Financial Secretary
- Local Government Legal Adviser
- Local Government Organizing Secretary
- Local Government Publicity Secretary
- Local Government Woman Leader
- Local Government Youth Leader
- Local Government Auditor
ARTICLE 59 FUNCTIONS OF THE LOCAL GOVERNMENT WORKING COMMITTEE
The Local Government Working Committee shall:
- Undertake the day-to-day administration of the PARTY in the Local Government and shall be responsible to the Local Government Executive Committee.
- Perform such other functions as may be assigned to it by the Local Government Executive Committee.
ARTICLE 60 MEETINGS OF THE LOCAL GOVERNMENT WORKING COMMITTEE
- The Local Government Working Committee shall meet not less than twice a month at the instance of the Chairman. Such meeting shall be preceded by an online meeting, where the agenda of the proposed meeting shall be set and agreed upon.
- An extra-ordinary meeting of the Local Government Working Committee shall be held if requested by two-third of the members of the Committee and such meeting shall be held within seven [7[ days of the request.
PART THIRTEN
WARD EXECUTIVE COMMITTEE
ARTICLE 61 COMPOSITION OF THE WARD EXECUTIVE COMMITTEE
There shall be a Ward Executive Committee which shall consist of:
- Ward Party Chairman
- Deputy Ward Party Chairman
- Secretary
- Assistant Secretary
- Elected Local Government Chairman and Deputy Local Government Chairman who are members of the PARTY.
- Treasurer
- Financial Secretary
- Organizing Secretary
- Legal Adviser
- Publicity Secretary
- Women Leader
- Youth Leader
- All members of the National, Regional, State and Local Government Area Executive Committees who are from the Ward.
- All members of the Board of Trustees who are from the Ward.
- Public Office holders from the Ward who are members of the PARTY.
- Coordinator of the Physically Challenged in the Ward.
ARTICLE 62 MEETINGS OF THE WARD EXECUTIVE COMMITTEE
- The Ward Committee shall meet at least once a month.
- Meetings of the Ward Executive Committee shall be summoned by the Ward Chairman. Such meeting shall be preceded by an online meeting where the Agenda of the proposed meeting is set and agreed upon.
- An extra ordinary meeting of the Ward Executive Committee shall be held if requested online, by at least two-third of the members of the Committee. Such meeting shall be held within seven[7] days of the request if made in a previous online meeting.
- The quorum of the Ward Executive Committee shall be one-third of its membership and a simple majority shall pass any motion.

PART FIFTEEN
THE NATIONAL CONVENTION
ARTICLE 66 COMPOSITION OF THE NATIONAL CONVENTION
There shall be a National Convention of the PARTY which shall consist of:
- The National Convener who shall be the Chairman
- All members of the National Executive Committee.
- All members of the Board of Trustees.
- All members of the Regional Working Committee
- All State Chairmen of the PARTY.
- All State Women Leaders
- All State Youth Leaders
- Senatorial Executive Committee Chairmen and Deputy Chairman.
- Local Government Area Committee Chairmen.
- All elected Local Government Council Chairmen who are members of the PARTY.
- All Ward Chairmen and one Ward Caucus member.
- Former members of the National Working Committee.
- Serving and past Presidents and Vice Presidents of the Federal Republic of Nigeria who are Members of the Party.
- Serving and past Governors and Deputy Governors of States of the Federal Republic of Nigeria who are members of the Party.
- Serving and past members of the National Assembly who are members of the Party, serving and past Speakers, Deputy Speakers and other principal officers of the State Houses of Assembly , and all serving members of the State Houses of Assembly who are members of the Party.
- Members of the State House of Assembly who are members of the PARTY.
- One National Delegate from each of the Local Government Areas to be elected at the Local Government Area Congress for the purpose.
ARTICLE 67 FUNCTIONS OF THE NATIONAL CONVENTION
- The National Convention shall be the supreme and controlling authority of the PARTY within the limits prescribed in this Constitution and shall be the principal representative, policy making and administrative body of the PARTY.
- The National Convention shall have the supremacy in all matters pertaining to the PARTY and all Officers and organs of the PARTY shall be bound by the decisions of the National Convention in the exercise of their functions except where the exercise of such function is granted to other bodies specified in this Constitution.
- The National Convention shall have and exercise authority to:
- formulate policies and programs for the PARTY,
- elect or remove the National Officers of the PARTY,
- demand and receive reports from the National Executive Committee or organs of the PARTY, and take appropriate actions on such report,
- consider reports from the States and Local Government branches of the PARTY and take such decisions and actions as may be necessary to protect, advance and consolidate the gains and interest of the PARTY,
- at all elections, to secure the returns of as many candidates from the PARTY as possible, in a manner that is consistent with the laws of the land,
- determine the type and membership of Committees to be set up by the National Executive Committee,
- appoint such committees as it may deem necessary or desirable and assign such powers and functions to them as it may deem it fit,
- examine the actions taken or legislations proposed by any Government, whether Federal or State or Local Government and ensure they are in conformity with the policies and programs of the PARTY,
- raise adequate funds for the management and sustenance of the PARTY,
- appoint external auditors to audit the PARTY’s accounts,
- review, ratify, alter or rescind any decision taken by any of the Constituent bodies, organs or officers of the PARTY,
- delegate any of its powers to the National Executive Committee or any other organ of the PARTY,
- exercise such other powers and authority not inconsistent with the provisionsof this Constitution as shall aid or facilitate the realization of the objectives of the PARTY.
ARTICLE 68 MEETINGS OF THE NATIONAL CONVENTION
- The National Convention shall meet every four[4] years and shall determine its own procedures in accordance with democratic principles.
- A special National Convention may be convened at any time at the instance of the National Convener and/or National Executive Committee or if requested for by two-third majority of all the State Congresses, such National Convention shall be heldvirtually on appropriate social media platform to discuss only special matters.
- The quorum of the National Convention meeting shall be two-third of its membership and a simple majority shall pass any motion.
- Voting on key issues at the National Convention shall be by open ballot.
CHAPTER SIX
POWERS AND FUNCTIONS OF EXECUTIVEOFFICERS
ARTICLE 69 OFFICERS
- There shall be the following executive officers at all level of the Party, who shall be men and women of integrity and significant competence and shall perform functions assigned to them in this Constitution.
- The Chairman
- Deputy Chairmanand Vice Chairmen at National and state level
- The Secretary and Assistant Secretary
- The Treasurer and Assistant Treasurer
- The Financial Secretary and Assistant Financial Secretary
- The Organizing Secretary and Assistant Organizing Secretary
- The Publicity Secretary and Publicity Secretary
- The Legal Adviser and Assistant Secretary
- The Woman Leader and Assistant Woman Leader
- The Youth Leader and Assistant Youth Leader
- The Auditor and Assistant Auditor
- Ex-Officios
- Other Officers as may from time to time be required for the effective administration of the party at any level
ARTICLE 70 THE CHAIRMAN
There shall be a Chairmenat all levels of the PARTY and his or her functions shall be to:
a. summon and preside over meetings
b. provide firm and effective leadership and direct activities of the PARTY under the overall supervision of the National Executive Committee
c. promote and defend the integrity, policies and program of the PARTY and make pronouncement for and on behalf of the National Executive Committee
d. assign specific functions to any member or officers of the PARTY
e. delegate his or her powers to the Deputy Chairman
f. present to the National Convention a comprehensive statement of the Organs, Levels or Chapters of the PARTY on political matters generally
g. ensure strict compliance with the provisions of this constitution, and the principles, policies and programs, aims and objectives of the PARTY.
ARTICLE 71 DEPUTY CHAIRMAN
(1) There shall be Deputy Chairman at all levels of the PARTY provided that at the National level, there shall be two (2) Deputy National Chairmen, one representing the North and the other representing the south.
(2) The functions of the Deputy Chairmen shall be toassist the Chairman in the discharge of his or her duties, deputize in the latter’s absence as well as perform other functions as may be assigned to him or her by the executive committee at the level.
ARTICLE 72 VICE CHAIRMEN
(1) There shall also be six (6) vice chairmen from each of the six geopolitical region of the country who shall also serve and be known as the Regional Chairmen.
(2) The Vice National Chairmen shall also double as their respective Regional Chairmen and shall at the national level assist the chairman and deputy national chairmen in the discharge of their duties.
(3) In the absence of the National CHAIRMAN and the two Deputy National Chairmen, any of the six Vice Chairmen may be appointed to chair any meeting of either the National Executive Committee or that of the National Working Committee of the party.
ARTICLE 73 THE SECRETARY AND ASSISTANT SECRETARY
(1) There shall be a Secretary at all Levels, Organs and Chapters of the PARTY, who shall perform the following functions:
a. supervise the day to day activities of the PARTY,
b. conduct or direct the conduct of the correspondences of the PARTY and issues notices of meetings, either online or physical,
c. keep or cause to be kept all records of proceedings of meetings as well as other records of the PARTY,
d. ensure the implementation of decisions and directives at all Levels, Organs and Chapters of the PARTY,
e. render a written report of the activities of the PARTY,
f. consult the Chairman in the discharge of his or her duties,
g. carry out any other duties as may be assigned to him or her, from time to time.
- There shall be an Assistant Secretary at all Levels, Organs and Chapters of the PARTY who shall assist the Secretary in the discharge of his or her duties, and shall deputize in the latter’s absence.
ARTICLE 74 THE TREASURER AND ASSISTANT TREASURER
(1) There shall be a Treasurer at all Levels, Organs and Chapters of the PARTY, who shall preferably be an Accountant or someone with demonstrable prudence, who shall perform the following functions:
a. ensure prudent management of the PARTY’s funds,
b. receive and promptly pay into the PARTY’s account all monies received for and on behalf of the PARTY and tightly keep all cheques books and banking documents of the PARTYs,
c. if for any reason, it is impossible to pay any received money into the account, the funds must be paid within 48 hours after collection, and
d. prepare and submit a yearly statement of account and periodic reports to the National Executive Committee.
(2) There shall be an Assistant Treasurer at all Levels, Organs and Chapters of the PARTY who shall assist the Treasurer in the discharge of his or her duties, and shall deputize in the latter’s absence.
ARTICLE 75 THE FINANCIAL SECRETARY AND ASSISTANT FINANCIAL SECRETARY
(1) There shall be a Financial Secretary at all Levels, Organs and Chapters of the PARTY who shall perform following functions:
- collect and keep records of all dues, levies, donations, subscription belonging to the PARTY,
- prepare and submit proposals for raising funds for the PARTY for consideration by higher Executive organ or body,
- undertake and strictly supervise budgeting and financial reporting,
- protect the assets of the PARTY and institute operating procedures through internal control,
- establish and coordinate policies for investment of funds to generate income for the PARTY.
(2) There shall be an Assistant Financial Secretary who shall assist the Financial Secretary in the discharge of his or her duties and shall deputize in the latter’s absence.
ARTICLE 76 THE ORGANIZING SECRETARY AND ASSISTANT ORGANIZING SECRETARY
(1) There shall be an Organizing Secretary who shall perform the following functions:
a. initiate programs for general mobilization of members of the PARTY and the recruitment of new members,
b. coordinate the field activities of the PARTY,
c. harmonize all information and decisions of the PARTY,
d. liaise with both Woman Leaders and Youth Leaders to harmonize programs for the attainment of the PARTY’s success at all elections,
e. appraise the problems of the PARTY and proffer solutions to them, and
f. organize seminars, workshop, rallies and campaign programs for the attainment of the PARTY’s objectives.
(2) There shall be an Assistant Organizing Secretary who shall assist the Organizing Secretary in the discharge of his or her duties and shall deputize in the latter’s absence.
ARTICLE 77 THE PUBLICITY SECRETARY AND PUBLICITY SECRETARY
(1) There shall be a Publicity Secretary who shall perform the following functions:
a. coordinate all information and publicity relationship of the PARTY,
b. be the Chief image maker of the PARTY , and
c. cause to be publicized, the policies and programs of the PARTY in line with the aims and objectives of the PARTY.
(2) There shall be an Assistant Publicity Secretary who shall assist the Publicity Secretary in the discharge of his or her duties, and shall deputize in the latter’s absence.
ARTICLE 78 THE LEGAL ADVISER AND ASSISTANT SECRETARY
(1) There shall be a Legal Adviser at all Levels,Organs and Chapters of the PARTY who shall be a Lawyer of not less than 10 years post call, who shall perform the following function:
a. advise the PARTY on all Legal matters,
b. conduct all litigations and prosecute and defend actions on behalf of the PARTY, including Organs and Officials in so far as the subject of litigation affects the interest of the PARTY,
c. interpret the laws, regulations and constitution of the PARTY in the event of any ambiguities.
(2) There shall be an Assistant Legal Adviser, who shall be a Lawyer of not less than 10 years post call experience, who shall assist the Legal Adviser in the discharge of his or her duties and shall deputize in the absence of the latter.
ARTICLE 79 THE WOMAN LEADER AND ASSISTANT WOMAN LEADER
(1) There shall be a Woman Leader at allstructural levels of the Party, Organs and Chapters of the PARTY who shall perform the following function:
a. mobilize and organize women for the party
b. initiate and implement strategic programspolicies aimed at endearing the PARTY to women, home and abroad,
c. coordinate the activities of women at all Levels, Organs and Chapter of the PARTY.
(2) There shall be an Assistant Women Leader who shall assistthe Woman Leader in the discharge of her duties, and shall deputize in the latter’s absence.
ARTICLE 80 THE YOUTH LEADER AND ASSISTANT YOUTH LEADER
(1) There shall be a Youth Leader at all Levels, Organs and Chapters of the PARTY who shall perform the following functions:
a. mobilize the youths for the attainment of the objectives of the PARTY,
b. initiate and implement strategic programs and policies aimed at endearing the PARTY to the youths.
(2) There shall be an Assistant Youth Leader who shall assist Youth Leader in the discharge of his or her duties, and shall deputize in the latter’s absence.
ARTICLE 81 THE AUDITOR AND ASSISTANT AUDITOR
(1) There shall be an Auditor at all Levels,Organs and Chapters of the PARTY who shall be an Accountant and shall perform the following functions:
a. audit books of account of the PARTY and report to the National Executive Committee,
b. present the audited account to the National Convention,
c. carry out any other functions as may be directed by the National Executive Committee or the next higher level or organ.
(2) There shall be an Assistant Auditor who shall assist the Auditor in the discharge of his or her duties, and shall deputize in the latter’s absence.
ARTICLE 82 OTHER OFFICERS
(1) There shall be other elected or appointed Officers of the party as may become necessary for the effective implementation and attainment of the party’s objective and as may be prescribed by the National Executive Committee; such other officers of the party shall perform such functions as may be assigned to them from time to time by the National Chairman.
(2) Subject to the express provision[s] of this Constitution, all other Officers at the Zonal, State, Local Government Area/ Area Council and Ward levels shall have the same powers and functions at their respective levels as prescribed for other National Officers provided that Legal Advisers particularly at all levels shall as far as practicable be Legal Practitioners..
CHAPTER SEVEN
ARTICLE 83 RESIGNATION OR REMOVAL OF EXECUTIVE OFFICERS
(1) A vote of no-confidence may be moved on any member of the Executive Committee of the Party at any level at any National Convention or congress of the Party two years into the tenure of such member of the Executive Committee, and where such a vote is passed, the Executive Committee member shall be replaced at that National convention or congress, as the case may be. Provided that two months’ notice of such vote of confidence motion shall be given to the Secretariat in order to circulate it to the relevant chapters one month before the National Convention or Congress, as the case may be.
(2) A vote of no-confidence shall be deemed defeated if not passed by a simple majority of the members of the Party at the Convention or Congress sitting and voting.
(3) Any officer elected into the Executive Committee of the Party at any level may resign his or her office by giving thirty days’ notice in writing (unless waived by him) to the appropriate Executive Committee, except in the case of resignation for the purpose of vying for an elective office which shall be effective within the period stipulated in the guideline issued for such elective office by the State Executive Committee in respect of Local Government elections.
(4) Where a vacancy occurs in any of the offices of the Party, the Executive Committee at the appropriate level shall appoint another person from the area or zone where the officer originated from, pending the conduct of election within 8 weeks to fill the vacancy.
(5) Where a National Officer resigns or isremoved from office, under the provisions of this Constitution, he or she shall immediately hand over to the Secretary all records, files and other properties of the PARTY in his or her possession.
(6) In the case of a National Chairman, he or she shall handover to the Deputy National Chairman who shall act as the National Chairman pending the election of a replacement.
(7) In the case of a National Secretary, he or she shall hand over to the Assistant National Secretary.
(8) The above provision shall apply equally to other levels of the PARTY’s structure.
ARTICLE 84 TENURE OF OFFICE
- Except as otherwise provided in this Constitution, all Officers of the PARTY, elected or appointed into the PARTY’s Organs, National, Regional, State, Senatorial District, Local Government Area, Ward, shall serve in such office for a single term of four (4) years and shall be eligible to contest other position of in the party.
- No member shall serve in the same office for more than four[4] years, except he or she is a founding member, member of the Board of Trustees, a person who first came to the office by filling a vacancy, or a person elected as an interim executive officer prior to registration of the Party.
- No member can be an Officer at the National and State levels or National Organ of the PARTY concurrently, other than being an ex-officio of that Organ.
- Except as otherwise provided in this Constitution, all Officers of the PARTY, elected or appointed into the PARTY’s Organs, National, Regional, State, Senatorial District, Local Government Area, Ward prior to the registration of the party by the Independent National Electoral Commission (INEC) shall be considered as interim and, shall serve in such office for a period not exceeding six months after the registration of the party during which the party shall mobilize and inject more members as well as hold congresses at all levels to elect new executive officers for a four year tenor.
- Any person elected as interim executive officer of the party prior to registration shall be eligible to contest election into the same office for a former tenor of four (4) years after the party had been registered by the Independent National Electoral Commission (INEC)
ARTICLE 85 POWERS OF OFFICERS AT OTHER LEVELS
- Except where the provisions of this Constitution state otherwise, all other Officers at the Regional, State, Local Government Area and ward shall, in relation to their respective functions, have the same powers as their corresponding National Officers.
- Subject to the provision of this Constitution, all Executive Committees shall have power to set up Committees where necessary, desirable and expedient and shall assign to them such powers and functions as may be deemed appropriate.
- The Executive Committee at all levels shall in the appointment or election of members of Executive Committee observe and apply the principles of Federal Character.
ARTICLE 86 MODE OF ELECTION AND APPOINTMENT OF EXECUTIVE OFFICERS
- The National Convention, Regional, State, Local Government Area and Ward Congresses shall convene to elect or appoint the Officers of the PARTY at the various levels of the structure of the PARTY according to the geo-political zones.
- Every registered and financial member of the PARTY who has satisfied all the requirements for nomination and election, or any other rules and regulations of the PARTY in force, shall be eligible to contest for any office of the PARTY.
- The guidelines for election to any office of the PARTY shall be approved by the National Executive Committee in accordance with the provisions of this Constitution.
- No member of the PARTY shall be eligible for nomination for election or appointment into any of the offices of the PARTY, unless he or she has been duly registered as member and is of good financial standing in the PARTY.
- The party shall adopt parliamentary system of government at the national and regional level and as such election/ selections of national and executive officers shall be through Electoral Collegefrom the state level.
ARTICLE 87 NOMINATION OF CANDIDATES FOR ELECTION INTO PUBLIC OFFICES
- The National Executive Committee shall, subject to the provisions of the Constitution of the Federal Republic of Nigeria, 1999 [as amended], and this Constitution, formulate the guidelines and regulations of the nomination of candidates for election into public offices at all levels.
- The National Executive Committee shall be the final authority for resolving all disputes relating to the choice of candidates for the PARTY for any public office election and for conveying to any appropriate authority concerned, confirmation of the list of names of candidates of the PARTY in any elective public office in the federation.
- The National Executive Committee, through the National Working Committee shall regulate the procedures for selecting the PARTY’s candidates into National Offices.
- The National Executive Committee, through the National Working Committee shall decide and regulate the procedures for selecting candidates aspiring for nomination into National Assembly, State House of Assembly, and as, Governor, Deputy Governor, Chairman or Vice Chairman.
- The State Executive Committee shall decide and regulate the procedures for selecting the candidates aspiring to the position of Councilors and Local Government Council Chairman.
- There shall be a minimum of one year membership span of the Party before a member becomes eligible to be nominated and or sponsored for political appointment, without any prejudice to the discretion of the appropriate authority.
- Where the appropriate authorityrules to the contrary, the ruling must be approved by the immediate higher Executive Committee, except for the National Executive Committee which is the final authority.
- No member of the PARTY shall be eligible for nomination for election or appointment into any public office(s) by the PARTY, unless he or she has been duly registered as member for a period not less than 6 months, and is of good financial standing in the PARTY, having been sponsored by the Directorate of Treasury and Revenue (DTR) orif he or she is an executive Officer of the party at the level of the nomination or appointment except where there is a waiver by appropriate Executive Committee.
- Candidates for all the PARTY’s positions and or nomination for any public offices must possess a minimum of secondary school certificate or its equivalent as requisite qualification to be eligible to contest except that is waived by the relevant Executive Committee at the level where he or she is being nominated provided also that the prerequisite for literacy shall not be mandatory at the Ward level.
- Any candidate nominated and sponsored for any political position either by appointment or by election must subscribe to the parties standing order for political office holders as well as undertaking to be committed financially to the party throughout his or her tenor in such office.
- Where any member elected or appointed into political office of the federation under the platform of the party quit and defect to another political party, such member shall vacate his or her political sit within 30 days of defection.
- The party in considering candidate for nomination into the office of the president of the federation shall ensure power rotation between the North and the south as well as the six geopolitical zones of the country. Similarly the party in nominating candidate for election into any position in any other level of shall ensure the principal of power rotation between the various or major ethnic groups within the said component unit.
CHAPTER NINE
ARTICLE 88 STANDING AND AD-HOC COMMITTEES
- The National Executive Committee shall have power to set up Standing Committee(s) and where necessary, Ad-hoc Committees.
- Pursuant to Article88 (1) above, the PARTY shall have the following Ad-hoc Committee(s) among others whose membership shall be proposed by the National Executive Committee and ratified by the Board of Trustees:
a. Standing Committee:
b. Finance Committee
c. Publicity Committee
d. Constitution Review Committee
e. Ad-hoc Committees:
f. Screening/ Selection Committee
- The State, Local Government Area and Ward Executive Committees may set up Ad-hoc Committee(s) at the State, Local Government Area and Ward Levels of the PARTY.
- Where the National Executive Committee has set up Standing and/or Ad-hoc Committee(s) or has assumed jurisdiction on any issue, no organ of the PARTY shall deliberate upon or set up a similar or parallel Committee.
ARTICLE 89 DUTIES AND FUNCTIONS OF STANDING AND AD-HOC COMMITTEES
(1) FINANCE COMMITTEE
The Finance Committee shall be headed by the National Treasurer as Chairman and shall comprise a minimum of seven [7] members (inclusive of the National Financial Secretary), who shall be nominated by the National Executive Committee and approved by the Board of Trustees and shall advise the PARTY on ways and means of generating funds and investing same for the PARTY in accordance with the provisions of this Constitution.
(2) PUBLICITY COMMITTEE
The Publicity Committee shall be headed by the National Publicity Secretary and shall comprise seven[7] members to be nominated by the National Executive Committee and approved by the Board of Trustees and shall advise the PARTY on arrangement of information, public relations, mass media matters and community affairs.
(3) SCREENING AND SELECTION COMMITTEE
a. The Committee shall be headed by a Chairman and shall comprise of six [6] members that shall be recommended by the National Executive Committee and ratified by the Board of Trustees.
b. The Committee shall be responsible for the screening of the PARTY’s aspirants for nomination or election into the following offices:
i. President
ii. Vice President
iii. Governors
iv. Deputy Governors
v. Members of the National and State Houses of Assembly.
vi. Party Chairman
vii. Deputy Chairman
c. The list of candidates elected at the PARTY’s Congresses and Conventions for the above-mentioned offices, shall be forwarded after the disposal of any appeal to the Board of Trustee for ratification/confirmation as candidates for National/general elections or elected officers of the PARTY, whichever is applicable.
d. Members of this Committee shall not be eligible to contest for any political or elective position in the same election for which they are serving as members.
CHAPTER TEN
FUNDING
ARTICLE 90 SOURCE OF FUND
(1) There shall be established and maintained for the PARTY a fund into which shall be paid all the following:
- Subscriptions, fees and levies from members
- Dues and or levies from public offices holders
- Subventions, donations, and proceeds of fund raising
c. Proceeds from the investment made by the PARTY
d. Gifts and grants by Governments, individuals or groups of individuals as allowed by Law.
e. Loans approved by the National Executive Committee’ and
f. Such other monies as may be lawfully received by the PARTY.
(2) The various individuals, allies and honorary Awardee of the PARTY who enjoy patronage from the PARTY at National, Regional, State,and Local Government levels shall be encouraged to make donations annually to the PARTY.
(3) The PARTY shall organize National Convener’s Annual Fund raising dinner at which friends, Awardees and members of the PARTY will be charged in a manner to be recommended by the National Finance Committee and approved by the National Working Committee, to raise funds for the PARTY.
ARTICLE 91 BORROWING POWER
(1) The PARTY may, with the consent of or in accordance with the general authority given by the National Executive Committee, borrow by way of loan or overdraft from any source, any money required by the PARTY to meet its obligations and functions under the Constitution.
(2) Subject to the provisions of this Constitution and the conditions of any trust in respect of any property, the PARTY may invest all or any of its funds with the consent or general authority of the National Executive Committee.
ARTICLE 92 TRANSPARENCY AND ACCOUNTABILITY IN THE FINANCE OF THE PARTY
(1) For the purpose of ensuring transparency and accountability in the management of the finances of the PARTY, the National Executive Committee shall design standard financial regulations to govern the management of the PARTY’s finances at all levels.
(2) At the National level, the President of the Federal Republic of Nigeria, if a member of the Party, shall ensure compliance with the provisions of this Constitution as it affects membership dues expected from Federal Republic Appointees, while the Senate Chairman and the Speaker of the House of Representatives, if members of the PARTY, shall ensure compliance with the provisions of this Constitution by members of the PARTY in the National Assembly.
(3) At the State level, the Governor of the State, if a member of the PARTY, shall ensure compliance with the provisions of this Constitution as it relates to membership dues in respect of all State political appointments, while the Speaker of the State House of Assembly, if a member of the PARTY, shall ensure compliance with the provisions of this Constitution by members of the party in the State House of Assembly.
(4) At the Local Government level, the Chairman of the Local Government Council, if a member of the PARTY, shall ensure compliance with the provisions of this Constitution by members of the PARTY in the Local Government legislative house.
ARTICLE 93 BANK ACCOUNTS
(1) The Party shall maintain bank account(s) in the headquarters of its various levels of organization, provided that where banking facilities are not available, the services of the Bank nearest to the city or town shall be utilized.
(2) The National Convener together with the National Executive Committee shall decide the banks to be used in keeping the accounts of the PARTY.
(3) The authorized signatories to the bank accounts and other financial transactions shall be the following:
a. The National Convener/National Chairman and his counterpart at the Regional, State, Local Government and Ward levels,
b. The National Secretary or his/her counterpart at the Regional, State, Local Government and Ward levels,
- The National Treasurer or his/her counterpart at the Regional, State, Local Government and Ward levels, provided that withdrawal from or debit instructions on the account shall be valid only if authorized by the National Chairman or his counterpart at other levels and any two other signatories.
ARTICLE 94 AUDIT OF ACCOUNT
- The National Executive Committee of the PARTY shall appoint a competent firm of Accountants to audit the accounts of the PARTY annually and present the report of the audited accounts at the National Convention.
- The Regional, State and Local Government Executive Committee shall similarly appoint a competent firm of accountants to audit the accounts of the PARTY at their respective levels annually and present the report of the audited account at their respective Congresses.
CHAPTER ELEVEN
ARTICLE 95 DISCIPLINARY PROCEDURES
- Subject to the provisions of this Constitution and the right room for fair hearing, the PARTY shall have the right to discipline any member.
- There shall be a Disciplinary Committee of the PARTY at every level, consisting of seven [7] members with proven integrity, one of whom shall be a Legal Practitioner.
- The Disciplinary Committee shall be appointed by the appropriate Executive Committee and shall have the power to discipline any erring member on behalf of the PARTY.
- A complaint or allegation by any member of the PARTY against another member, or an Executive Officer of the PARTY shall be submitted to the appropriate Executive Committee at all levels, which shall , not later than seven [7]days of the receipt of the complaint appoint a Disciplinary Committee to investigate the matter.
- The Executive Committee concerned shall not debate or discuss the complaint or allegation before sending it to the Disciplinary Committee which shall hear, determine and cause its decision to be transmitted to the relevant Executive Committee.
- Where any allegation is made against a member of the PARTY, the Disciplinary Committee shall inform the member in writing, of the allegation against him or her and the place and time of hearing the matter.
- A member who appears before a Disciplinary Committee shall, for fair hearing, be given the opportunity to present his or her case orally or in writing either in person or through a Legal Representative of his or her choice and shall be allowed to call witnesses.
- Any decision taken against a member who has not been informed of the allegation against him or her, or who has not been given any opportunity of defending himself or herself, shall be null and void.
- The Executive Committee concerned upon receipt of the report of the Disciplinary Committee shall not later than fourteen [14] days thereof either ratify or reject the decision of the Disciplinary Committee.
- The Executive Committee at the level where a complaint or allegation is made shall have original jurisdiction to hear and determine such complaint or allegation provided that the assumption of jurisdiction by such Executive Committee shall not breach the rules of fair hearing.
- For the purpose of the provisions of this Article:
a. The Local Government Executive Committee shall be adjudicatory body of first instance over complaints or allegations from the Ward level,
b. The State Executive Committee shall be the adjudicatory body of first instance over complaints or allegations from the Local Government Area/Area Council level,
c. The Regional/zonal Executive Committee shall be the adjudicatory body of first instance over complaints or allegations from the State Chapter in the region/zone,
d. The National Executive Committee shall be the adjudicatory body over complaints and allegations from the regions/zones.
12. The Working Committee at any level, may after preliminary hearings, suspend a member from the PARTY for a period not exceeding one month, during which period the member so suspended, shall lose his or her right to vote or be voted for, and shall be referred to the Disciplinary Committee.
ARTICLE 97 RESOLUTION OF CRISES (ROC)
In the event of a lingering unresolved crises, the national convener or pioneer National Chairman who is the Leader of the Party shall be consulted to mediate over crises and his decision thereon shall be final. In the absence of the National convener or the pioneer Chairman, resolution of the crises shall be referred to the Caucus Committee.
ARTICLE 98 OFFENCES
Subject to the provisions of this Constitution, the PARTY shall have the power to discipline any member who commits any of the following offences:
- A breach of any provision of this Constitution.
- Anti-Party activities or any misconduct which is likely to embarrass or have adverse effect on the PARTY or bring the PARTY into hatred, contempt, ridicule or disrepute.
- Disobedience or negligence in carrying out lawful directives of the PARTY.
- Any act of impersonation of the PARTY’s Offices or its holders.
- Giving wrong information to any organ of the PARTY or unauthorized publicity of the PARTY’s dispute without exhausting all avenues for settlement within the PARTY.
- Fractionalization or creating parallel organs of the PARTY at any level. Or belonging to any group under the guise of the PARTY.
- Flouting the rules, regulations and decisions of the PARTY, engaging in dishonest practices capable of defrauding the PARTY.
- Continuously being absent from meetings to which he/she is invited without any justifiable reason.
- Engaging in thuggery and carrying out activities which tend to disrupt the peaceful, lawful and efficient organization of the PARTY or which are inconsistent with the aims and objectives of the PARTY.
- Carrying arms, offensive weapons or missiles at a political rally or procession, meetings, offices or voting centers other than in pursuance of a lawful duty.
- Filing an action in Court of Law against the PARTY or any of its Officers on any matter relating to the discharge of the duties of the PARTY and its Officers without first exhausting all avenues for redress provided for in this Constitution.
- Alteration of Delegates List, falsification of nomination results, and or tampering with the processes of internal democracy of the PARTY.
- Engaging in any conduct likely to cause disaffection among members of the PARTY or is likely to disrupt the peaceful, lawful and efficient conduct of the administration of the Party.
ARTICLE 99 SANCTIONS
(1) The PARTY shall have power to impose any or a combination of the following sanctions on any member who commits any of the offences listed in Article98, in accordance with the nature and gravity of the offence:
i. Reprimand
ii. Censure
iii. Fine
iv. Debarment from holding any Office in the PARTY,
v. Removal from PARTY’s office,
vi. Expulsion from the PARTY.
- Debarment from contesting office on the platform of the PARTY
(2) Subject to the provisions of this Constitution, the Executive Committee at any level of the PARTY shall have power to decide any of the disciplinary measure to be taken against any member of the PARTY.
(3) In appropriate circumstances, the PARTY shall in addition to any of the foregoing disciplinary measure, cause prosecution of the erring member or erstwhile member where his or her membership has been terminated.
(4) Where it is proposed to expel a member of the Executive Committee, political office holder, or a member of a Legislative House, from membership of the PARTY, such a proposal shall be submitted to the National Executive Committee, which after deliberation on the matter may confirm or reject the proposal.
(5) A decision to expel a Member of the PARTY taken or confirmed by the National Executive Committee shall be submitted to the Board of Trustees for ratification.
(6) The National Executive Committee shall on receipt of the report of the disciplinary Committee make a decision on the matter within fourteen[14] days.
(7) Any member who files an action in court of law against the PARTY or any of its Officers on any matter relating to the discharge of the duties of the PARTY without first exhausting the avenues for redress provided for in his Constitution shall automatically stand expelled from the PARTY on filing such actions and no appeal against such expulsion as stipulated in this clause shall be entertained until the withdrawal of the action from the Court by the Member.
(8) Each Organ of the PARTY shall have power to remove any Officer or Officers as the case may be from office at that level for failing to discharge his, her or their responsibilities.
(9) Subject to the provisions of this Constitution, the National Executive Committee shall have the power to expel any member of the PARTY for acts of indiscipline or misconduct capable of bringing the PARTY to disrepute.
ARTICLE 100 APPEAL
- Any member of the PARTY who is aggrieved by a decision taken against him or her by any organ or Officer shall report to the appropriate authority.
- If he or she is still not satisfied, he or she shall have the right of appeal to the immediate higher Organ of the PARTY within fourteen [14] days of the decision.
- All appeals must be dealt with timeously and expeditiously by the appropriate appeal body in any event not later than three [3] weeks after filing the notice of appeal to the appropriate Executive Committee.
CHAPTER TWELVE
MEETINGS
ARTICLE 101 GENERAL RULES FOR PROCEEDINGS OF
MEETINGS
- No motion shall be entertained at a meeting unless at least three [3] days’ notice of such motion had been given in writing to the Secretary or to the Chairman, except;
a. A motion that any subject be deferred or referred to a Committee or some appropriate body,
b. A motion for adjournment, and
C. A motion proposing an amendment to some opinion or motion already presented at the same meeting.
- Every motion and amendment of any motion shallbe seconded before discussion.
- A motion for amendment of any motion may bewithdrawn at any time at the request of the member that moved the motion.
- The proceedings of the meetings of the PARTYat all levels shall be in English language or Nigerianlanguage understood by a majority of members present at any given meeting.
- All the meetings of the PARTY shall be chaired by the Chairman or in his or her absence, the Deputy Chairman at the relevant level. And in the absence of both the Chairman and the Deputy Chairman, member present shall elect a member among them to preside over the meeting.
- The rules and regulations governing the conduct of meetings of the PARTYshall be as approved, from time to time by the National Executive Committee of the PARTY.
ARTICLE 102 QUORUM
Except as otherwise expressly provided for in this Constitution, one-third of the members of any Organ of the PARTY shall constitute a quorum for a valid meeting.
ARTICLE 103 VENUE OF MEETINGS
The venue of meetings of organs of the PARTY at all levels shall be as approved by the leadership of the PARTY or the Organ at such level.
ARTICLE 104 NOTICES
The Notices for all meetings at any level shall be a minimum of 7 days for statutory meetings or constitutional meetings, and not less than 24 hours for emergency meetings except where the emergency is of grave consequence then the Notice shall be immediate, provided that any decision pursuant to an immediate Notice, if not reached by a two third majority, must be ratified by a majority of members of the that particular organ through a virtual meetings.
CHAPTER THIRTEEN
MISCELLANEOUS PROVISIONS
ARTICLE 105 UNIVERSAL RULES
- Provided always that in pursuit of all the provisions herein contained in this Constitution, the following shall ensure that;
a. No person shall be eligible to contest any position in the PARTY, or be nominated by the PARTYas its candidate at any election, if the person is not a registered member of the PARTY.
b. All nomination, into elective position shall be supported by a specified number of nominators from the Ward and/or relevant Constituencies as may beprescribed or provided for in the PARTY’s electoral guidelines.
c. Any office holder of the PARTY interested in contesting for an elective position (whether Party office or in a general election) shall resign and leave office on date of his or her swearing into the public office.
ARTICLE 106 WAIVER
- Subject to the approval of the National Executive Committee, the National Working Committee may in special circumstances grant a waiver to a person not otherwise qualified under Article 105 of this Constitution if, in its opinion, such a waiver is in the best interest of the PARTY.
(2) A person may be granted a waiver on the following conditions:
a. He or she has not been convicted by any court of competent jurisdiction.
b. He or she has applied for waiver in writing to the National Working Committee through his or her appropriate Ward, Local Government Area/ Area Council, State, Federal Capital Territory or Regional Committee.
c. He or she has signed an undertaking to uphold and implement the manifesto of the PARTY in the event of winning the election.
ARTICLE 107 CONTRACTUAL OBLIGATIONS
(1) The PARTY shall be a corporate body with perpetual succession and can sue or can be sued in its corporate name with power to acquire, hold and alienate property, enter into agreements and to do all things necessary to carry out its aims and objectives and defend its members, properties and reputation.
(2) Only National Officers of the PARTY shall have the authority to create any legal relationship binding on the PARTY.
ARTICLE 108 COMMON SEAL
There shall be a Common Seal of the PARTY which shall be in the custody of the NationalSecretary.
ARTICLE 109 OATH OF OFFICE
Every Officer elected or appointed as an Officer of the PARTY shall subscribe to the Oath of Office as prescribed in Schedule llto this Constitution, in the language that he or she understands, before an appropriate Principal Officer of the PARTY as may be approved by the National Working Committee.
ARTICLE 110 AMENDMENTS
- This Constitution and the Schedules hereto, can be amended only by the National Convention of the PARTY.
- Notice of any proposed Amendment by any member or Organ of the PARTY shall be given to the National Secretary of the party at least two months before the date of the National Convention. The notice which shall be in writing shall contain a clear statement of the proposed Amendment and the reasons thereof.
- The National Secretary upon receipt of the notice shall cause it to be circulated timely to all theState and other offices of the PARTY for publication at least one month before the date of the National Convention.
- Notice of the proposed Amendment shall be served on all members delegated to be at the National Convention at least fourteen[14] days before the date of the meeting at which the proposed Amendment is to be considered, provided that such notice shall be deemed served where it is sent to members email or through appropriate verified electronic media.
- The Constitution or any part thereof shall stand amended if a proposed Amendment is supported by at least two-third majority of the delegates present and voting.
ARTICLE 111 RULES FOR STAFF
- All employees of the PARTY shall be bound bythe provisions of this Constitution, the rules and regulations of the PARTY and the decisions of the National Executive Committee and other Organs of the PARTY.
- All employees of the PARTY shall be subject to the direct control and discipline of the National, Regional, State, Local Government Area and Ward Secretaries of the PARTY.
- A person who seeks and obtains employment in the PARTY shall be deemed to be a member of the PARTY.
- Any employee of the PARTY who acts in a manner likely to bring contempt, disrepute or ridicule to the PARTY or its Officers or take part in subversive activities against the PARTY shall, if found guilty, be immediately relieved of his or her post.
- Any employee that errs shall be given the opportunity of fair hearing to defend himself or herself before disciplinary action is taken..
- No employee of the PARTY shall seek nomination for election into any post in the PARTY, except he or she resigns his or her employment one month before the date of election.
- The remuneration of the employees of the PARTY shall be determined by the appropriate Executive Committee of the party at the respective levels from National to Ward.
ARTICLE 112 INTERPRETATION
(1) Except on express words of this constitution, any divided questions as to the meaning of any section of this constitution or the Schedule hereto shall be referred to the National Executive Committee whose interpretation of the same shall be final.
(2) In this constitution:
- “ADR “ means Alternative Dispute Resolution
- “Constitution” means CONSTITUTION OF THE AFRICAN REFORMATION PARTY.
- “Funds” include valuable properties;
- “He” or “His” shall include the female gender;
- “The Party” means AFRICAN REFORMATION PARTY; and shall include its constituted organs as the case may be.
- “Month” means calendar month;
- Where computation of any figure in this Constitution results in a fraction, the figure obtained shall be approximated to the nearest whole number;
- ” BOT” means Board of Trustees
- “Congress” a large formal meeting or series of meetings where representatives from different party levels discuss ideas, make decisions, pass resolutions and conduct election;
- “National Convention” – The largest meeting of the party at National level which is the highest authority of the party where decisions are ratified and Presidential candidates and national Officers are elected;
- “National” – This refers to Federal level as contained in the constitution of the Federal Republic of Nigeria 1999.
- “Regional or Zonal” – These refer to each of the geo-political entities viz: North/East, North/Central, North/ West, South/East, South/West, South/South.
- “State” – This refers to geographical entity as defined in the Constitution of Federal Republic of Nigeria 1999.
- “Local Government Area” – This refers to the Local Government Area as defined by S.7 and particularly schedule 2 of the constitution of Federal Republic of Nigeria 1999.
- “Ward” – This refer to the area delineation of the Local Government Area by the Independent National Electoral Commission.
- “Direct Primaries” – this refers to a Party Executive Congress to be held in each Ward and all registered and financial members of the Party to participate in electing a candidate of the Party for election into public office.
- “NEC” means or refers to the National Executive Committee
- “Emergency” means any situation that is capable of negatively affecting the party immediately.
SCHEDULE I
